Terms of Service

1. Acceptance of terms

By creating an account, you agree to these terms. If you're signing up on behalf of a company, you confirm you have the authority to bind that company to this agreement.

You must be at least 18 years old to use Ektie. We may update these terms from time to time. For material changes, we'll give you at least 14 days' notice before the new terms take effect — by email and via an in-app notice. Continued use after the effective date constitutes acceptance.

2. Your account

You're responsible for keeping your login credentials secure. Don't share your password, and don't let others use your account. You're responsible for all activity that occurs under your account — whether or not you authorised it.

If you suspect your account has been accessed without your authorisation, notify us immediately at support@ektie.com. We'll work with you to secure the account and investigate.

One account per workspace. You may invite team members to your workspace — each member gets their own login and access level. You're responsible for the activity of everyone you invite.

3. Subscriptions & billing

Plans are billed monthly or annually, depending on what you selected at signup. All payments are processed by Stripe. By providing a payment method, you authorise us to charge that method on each renewal date.

Subscriptions renew automatically unless you cancel before the renewal date. You can cancel at any time from your account settings — no phone call, no friction.

All payments are non-refundable. Because AI credits are consumed by agent activity the moment a billing period begins, we are unable to issue refunds for any portion of a paid period — monthly or annual. If you cancel, your plan remains active until the end of the current billing period, after which no further charges are made.

We recommend using the free plan to evaluate the product before upgrading. If you have a billing dispute, contact support@ektie.com and we'll review it in good faith.

We may change pricing with 30 days' notice. Price changes apply at the next renewal date after the notice period ends.

4. Acceptable use

Ektie is built for legitimate go-to-market work. You may not use the platform to:

  • Send spam or unsolicited bulk email in violation of CAN-SPAM, GDPR, or equivalent laws.
  • Scrape or systematically extract data from the platform for commercial redistribution.
  • Attempt to reverse-engineer, decompile, or otherwise derive the source code of our AI agent architecture.
  • Use the platform in any way that violates applicable law, including export controls and sanctions.
  • Create fake accounts, impersonate others, or misrepresent your identity or affiliation.
  • Interfere with or disrupt the security, integrity, or performance of the service.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

5. Intellectual property

Ektie owns the platform. That includes the code, design, AI agent architecture, brand, and all underlying technology. Nothing in these terms grants you a right to copy, modify, or distribute any part of the platform itself.

You own your data. CRM records, contact lists, sequences, agent outputs, AI Studio content, and anything else you create inside Ektie belongs to you. We don't claim ownership over your workspace data.

You grant Ektie a limited, non-exclusive licence to process your data solely for the purpose of operating and improving the service for you. We will never use your data to train AI models without your explicit, opt-in consent.

6. AI agents & data

Your agents run on AI inference provided by third-party model providers, including OpenAI and Anthropic. When an agent processes a task, the relevant workspace context is sent to the model API. We use zero-data-retention agreements with these providers where available.

Agent outputs are generated automatically. AI is good, but it's not infallible — outputs may occasionally be inaccurate, incomplete, or inappropriate for your specific situation. You are responsible for reviewing agent-generated content before using it in external communications, campaigns, or business decisions.

Ektie is not liable for decisions you make based on agent outputs. The agents are tools; the judgement is yours.

7. Warranties & liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We don't guarantee that the service will be uninterrupted, error-free, or perfectly accurate.

We target 99.5% monthly uptime as published in our SLA. Planned maintenance and events outside our control don't count against this.

To the fullest extent permitted by law:

  • Ektie is not liable for indirect, consequential, incidental, special, or punitive damages — including lost profits, lost data, or business interruption — even if we've been advised of the possibility.
  • Our total liability to you in any 12-month period is capped at the fees you actually paid us during that same period.

8. Termination

You may cancel your account at any time from your account settings. No email required, no phone call. Your access continues until the end of the current billing period.

We may suspend or terminate your account for breach of these terms with 7 days' notice. For serious violations — including illegal activity, security threats, or repeated abuse — we may act immediately without prior notice.

On termination, your data doesn't disappear overnight. You have 30 days to export everything from your dashboard — CRM contacts, sequences, agent logs, AI Studio assets, all of it. After 30 days, your data is queued for deletion and fully removed within 60 days of the termination date.

9. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions.

Disputes arising out of or relating to these terms or the service will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. The arbitration will take place in Delaware unless both parties agree otherwise.

You retain the right to bring small claims in a court of competent jurisdiction. Class action waiver: you and Ektie agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.
